Photo courtesy of the Orange County District Attorney&#8217;s Office.<\/p>\n<p>According to Orange County Superior Court records, Montes not only faces one felony count of murder, but also use of a firearm, possession of a controlled substance, and three felony counts of child abuse and endangerment. Child abuse and endangerment? Yes, apparently Montes thought that his children with Gutierrez, a 3-year-old boy, a 1-month-old boy and a 1-year-old girl, wouldn&#8217;t mind that he fatally shot their mother right in front of them.<\/p>\n<p>What with the verdict of a fatal stabbing due to a critique of driving skills, this murder sounds like it could have resulted from nothing more serious than a drug-fuelled rage-Montes was charged with possessing methamphetamine.<\/p>\n<p>Although investigators have determined that Montes was at the residence at the time of the shooting, by the time officers responded to the reports of a shooting in the 2100 block of East Banyan Drive, Montes had fled the scene. By that time, Gutierrez was beyond help, and was pronounced dead at the scene.
